This notice [“the Privacy Notice”] provides information regarding the purposes and methods of processing of personal data by the Terravision Mobile Device Application [“the App”].

Legal Basis for Processing

Contract

The primary legal basis for the processing is to enter into a contract with you and provide the contracted services. If you refuse to provide the necessary personal data or object to the processing of your personal data for this purpose the Company will not be able to provide services to you.

Legitimate interest

Your data may be processed where it is in the legitimate interest of the Company to promote and market its services, specifically, the Company may:

• process the data provided in order to carry out analyses and surveys of the market and statistics to detect the degree of user satisfaction and preferences with regard to the services covered by the Company’s activity;
• process the data provided by you and those gathered from your navigation on the Site in order to identify your commercial profile and use it for marketing, advertising, promotional and commercial purposes.
• inform you about new features of the App and, more generally, about the activities carried out by the Company.

For the purposes of processing, as illustrated above, and within the limits of the same, your data may also be communicated to third parties, public or private, such as companies carrying out market and statistical surveys, companies carrying out marketing, advertising, promotional and commercial activities.

Terravision may share your personal data with third parties for the purposes of providing services to you and marketing and promotion of the company.

Where we are legally required by the legislation of an applicable jurisdiction we may provide your personal data to government, law enforcement, regulatory, tax or other authorities.

Transfers to other countries

Terravision transfer your personal:

• between countries within the EU as necessary to provide services and for marketing and promotional purposes
• between the EU and United Kingdom [“UK”] as necessary to provide services and for business management and coordination, this data is protected by equivalency of data protection legislation between the two jurisdictions
• between the EU/UK and the United States of America [“US”], we may transfer usage and marketing data to Google LLC [“Google”] for purposes of web analytics, this data is protected by the EU-US and UK-US Data Privacy Framework to which Google is subscribed

Where you are not in the UK when using the App your data may pass through servers and networking facilities in any country: this is outside of our control, however data is encrypted when in transit.

Retention Periods

The company’s standard retention period for personal data is seven (7) years. We retain data for this period to facilitate subsequent bookings, to maintain proper business and tax records and for purposes of dealing with complaints or refunds.

We have a separate retention period for marketing data which is retained for three (3) years. Data which is used for marketing in the first three years but subsequently retained for other purposes is marked and/or separated from active marketing data.

We may retain certain data for longer periods in special circumstances for example where:

• it is necessary for providing a record of our compliance with data protection legislation
• it is relevant to a current, previous or anticipated legal action
• we are required retain data in order to meet a legal obligation (such as terrorist financing legislation)
• we have any other clearly expressible and reasonable cause to do so

You have the right not to be subject to automated decision making, although currently the company does not undertake any processing of personal data which would fall into this category.

Sources of Personal Data

Most of the personal data we process is provided by you in the course of booking and using our services.
Some data may be added by our staff or other service providers (such as non-uptake of purchased services).
Some data may be collected as you use the App (such as pages or screens viewed and links followed).
Some data may be provided by agencies or consultants providing anti-fraud or similar services.

Forums, Personal and Public Messaging

The Company may not be held liable under any circumstances for any direct communication of personal, sensitive or any other kind of data that you may provide in a forum, personal or public messaging service provided by the App.

Purchase or Merger of The Company

The Company reserves the right to transfer the data you provide to any third party purchaser of the Company.
